The Tribunal declined jurisdiction over claims
by the Israeli company under the Israel-Uzbekistan BIT and under the Uzbek
foreign investment law because of illegal payments made to secure the
investment. This is the second case in the history of ICSID, following World
Duty Free v. Kenya, in which jurisdiction was declined on grounds of
corruption
